Estate Planning

  • Why is Estate Planning important?
  • What do I need to prepare a Will?
  • How do I create a Trust?
  • Do I need both a Will and Trust?

Medicaid Planning

  • Will Medicaid take my home to pay for my care?
  • Will Medicaid pay for aides to come into my home to care for my parent?
  • Is there a way to protect my assets and still qualify for Medicaid?

Veteran's Pension Benefits

  • I was on a ship during the Vietnam war, does that satisfy the service requirement?
  • Can a widow of a veteran qualify for the Improved Pension?
  • Is my house a countable asset for financial qualification purposes?

Estate Planning

Many people believe that estate planning is nothing more than a way to determine “who gets what” when you pass away. While this is of course part of it, comprehensive estate planning provides for much more than just the distribution of assets. Estate Planning allows you to control your property while alive and able, to protect yourself and family in the event of disability, and to give what you have to whom you want, the way you want, and when you want while minimizing applicable taxes and fees.

Medicaid Planning

One of the most critical aspects of Elder Law is finding ways to pay for long-term care.

Medicaid Planning Concerns:

  • The Application Process
  • Asset Protection
  • Estate Recovery

Veteran's Pension Benefits

We have been helping Military Veterans and their Spouses obtain the Aid & Attendance Benefit (Veterans health care and long term care). Aid & Attendance is a program for Veterans and their surviving spouses to help pay for Assisted & Independent Living or Home Health Care.

At The Delaware Elder Law Center, we work with adult children and their parents in their desire to prepare for times of disability, to protect assets from the devastating cost of long term care, and to pass along their legacy.  This work encompasses the three areas of the law set out above.

We help our clients find solutions to problems like these and many more. We take a personal approach to the practice of law. We will devote the time to get to know you and gain a thorough understanding of your particular situation. Only then will we create a custom plan to address your needs and achieve your goals. Ultimately, we hope to provide you not only with a comprehensive plan, but greater peace of mind as well.
